Terms of Service

These Terms of Service ("Terms") govern your use of the SuperClass Car Service website (superclasscar.com), mobile application, and transportation services. By using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services

SuperClass Car Service provides transportation services including Non-Emergency Medical Transportation (NEMT), airport transfers, local car service, and hourly/as-directed service in the New York City metropolitan area. We operate under TLC License B01726.

2. Booking and Cancellation

• Bookings can be made by phone at (718) 367-2222 or through our website/app
• All bookings are subject to vehicle and driver availability
• Cancellations must be made at least 2 hours before the scheduled pickup time
• Late cancellations or no-shows may incur a fee
• NEMT rides are subject to authorization from your insurance provider

3. Pricing and Payment

• Rates are as quoted at time of booking or as listed on our Rates page
• Tolls, airport fees, and gratuity are not included unless stated otherwise
• We accept Visa, Mastercard, Discover, cash, and Medicaid (for eligible NEMT rides)
• Payment is due upon completion of the ride unless other arrangements are made
• We reserve the right to adjust rates with prior notice

4. Passenger Responsibilities

• Be ready at the pickup location at the scheduled time
• Provide accurate pickup and dropoff addresses
• Treat drivers and vehicles with respect
• Wear seatbelts at all times
• Children must be in appropriate car seats (which you must provide unless arranged in advance)
• No smoking, illegal substances, or dangerous items in the vehicle
• Passengers are responsible for damage to the vehicle beyond normal wear

5. NEMT-Specific Terms

• NEMT services require valid Medicaid or insurance authorization
• Rides are provided only to and from approved medical facilities
• Patients must provide accurate insurance and medical appointment information
• We reserve the right to verify insurance eligibility before providing service
• Wait times at medical facilities are subject to the terms of the authorization

6. Limitation of Liability

To the maximum extent permitted by law, SuperClass Car Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to missed appointments, delays due to traffic or weather, or loss of personal property left in vehicles.

Our total liability for any claim arising from our services shall not exceed the fare paid for the specific ride giving rise to the claim.

7. Indemnification

You agree to indemnify and hold harmless SuperClass Car Service, its officers, employees, and drivers from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

8. Intellectual Property

All content on our website and app, including text, graphics, logos, and software, is the property of SuperClass Car Service and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written consent.

9. Account Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these Terms, abusive behavior toward drivers, non-payment, or any other reason at our sole discretion.

10. Dispute Resolution

Any disputes arising from these Terms or our services shall be governed by the laws of the State of New York. You agree to submit to the exclusive jurisdiction of the courts located in Bronx County, New York, for resolution of any disputes.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. We will post the revised Terms on this page with an updated date.
